Esta ley existe para garantizar que los empleados reciban sus salarios finales con prontitud al ser despedidos o al renunciar, incentivando a los empleadores a cumplir con las obligaciones de pago de salarios. <\/p><p>Existen plazos espec\u00edficos en los que un empleador debe entregar su \u00faltimo cheque de pago, y son los siguientes:<\/p><ol><li>Despido o cese temporal: Si un empleado es despedido o cesado temporalmente, debe recibir su salario final inmediatamente, es decir, el d\u00eda del despido.<\/li><li>Renuncia con preaviso: Si un empleado renuncia con 72 horas de preaviso, tiene derecho a recibir su cheque de pago final en su \u00faltimo d\u00eda de trabajo.<\/li><li>Renuncia sin preaviso: Si un empleado renuncia sin dar un preaviso de al menos 72 horas, el empleador tiene 72 horas despu\u00e9s del \u00faltimo d\u00eda de trabajo para pagar el salario final.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3defd10 elementor-widget__width-initial elementor-widget elementor-widget-heading\" data-id=\"3defd10\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u00bfCu\u00e1l es la sanci\u00f3n por incumplimiento?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6791373 elementor-widget__width-inherit elementor-widget-tablet__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"6791373\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Si un empleador no paga intencionalmente los salarios finales dentro de estos plazos estipulados, debe pagar una multa equivalente a la tarifa diaria de pago del empleado por cada d\u00eda que los salarios permanezcan impagos, hasta un m\u00e1ximo de 30 d\u00edas. Esta multa se acumula cada d\u00eda calendario, incluidos los fines de semana y los d\u00edas festivos, no solo los d\u00edas en que el empleado habr\u00eda trabajado. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-986c4c3 elementor-widget__width-initial elementor-widget elementor-widget-heading\" data-id=\"986c4c3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">\u00bfQu\u00e9 salarios est\u00e1n cubiertos?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e350280 elementor-widget__width-inherit elementor-widget-tablet__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"e350280\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Los salarios incluyen:<\/p><ul><li>paga regular<\/li><li>horas extras (si est\u00e1n programadas regularmente)<\/li><li>comisiones<\/li><li>tiempo de vacaciones no utilizado,<\/li><li>otras formas de compensaci\u00f3n, como las contribuciones del empleador a los planes de jubilaci\u00f3n<\/li><\/ul><p>Sin embargo, los gastos <strong>no se consideran<\/strong> salarios seg\u00fan esta ley.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8abf13a elementor-widget__width-initial elementor-widget elementor-widget-heading\" data-id=\"8abf13a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Excepciones a la ley<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1f773e1 elementor-widget__width-inherit elementor-widget-tablet__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"1f773e1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Existe una excepci\u00f3n de \u00ab<strong>disputa de buena fe<\/strong>\u00bb en la que, si existe un desacuerdo leg\u00edtimo sobre la cantidad de salarios adeudados, es posible que no se aplique la sanci\u00f3n.<\/p><p>Esto debe basarse en la creencia razonable de que no se deben salarios o de que se debe una cantidad diferente.<\/p><p>Ciertos empleados sujetos a convenios colectivos o en industrias espec\u00edficas como la agricultura, el cine o el petr\u00f3leo podr\u00edan tener plazos diferentes para el pago final.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0e16e4a elementor-widget__width-initial elementor-widget elementor-widget-heading\" data-id=\"0e16e4a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Mecanismos de aplicaci\u00f3n<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f2cf86e elementor-widget__width-inherit elementor-widget-tablet__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"f2cf86e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Los empleados pueden presentar una reclamaci\u00f3n ante la Divisi\u00f3n de Cumplimiento de Normas Laborales de California (DLSE) o demandar a su empleador para recuperar tanto los salarios adeudados como las sanciones por tiempo de espera.
