elementor-size-default\">\u00bfQu\u00e9 es la Ley de represalias contra empleados de California?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-68341c6 elementor-widget__width-inherit elementor-widget-tablet__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"68341c6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<div class=\"css-146c3p1 r-bcqeeo r-1ttztb7 r-qvutc0 r-37j5jr r-a023e6 r-rjixqe r-16dba41 r-1adg3ll\" dir=\"ltr\"><p>La ley de represalias contra empleados de California, regida principalmente por las <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?lawCode=LAB&amp;sectionNum=98.6\" target=\"_blank\" rel=\"noopener\">secciones 98.6<\/a> y 1102.5 del C\u00f3digo Laboral de California, est\u00e1 dise\u00f1ada para proteger a los empleados de acciones adversas por parte de su empleador en respuesta a ciertas actividades o derechos protegidos.<\/p><p>Estas son las protecciones que se ofrecen:<\/p><ol><li><strong>Protecciones para denunciantes<\/strong>:<br>Los empleados que denuncian actividades ilegales, violaciones de la ley o problemas de seguridad en el lugar de trabajo est\u00e1n protegidos. Esto incluye la denuncia a agencias gubernamentales o dentro de la empresa. La secci\u00f3n 1102.5 del C\u00f3digo Laboral de California proh\u00edbe expl\u00edcitamente las acciones de represalia contra los empleados por divulgar informaci\u00f3n sobre la mala conducta del empleador a una agencia gubernamental o de aplicaci\u00f3n de la ley.  <\/li><li><strong>Quejas sobre salarios y horarios<\/strong>:<br>Los trabajadores est\u00e1n protegidos cuando se quejan de que no se les paga correctamente, incluidos los problemas relacionados con el salario m\u00ednimo, las horas extras, los descansos u otras normas laborales. Esto est\u00e1 cubierto por la Secci\u00f3n 98.6 del C\u00f3digo Laboral. <\/li><li><strong>Participaci\u00f3n en investigaciones o demandas<\/strong>:<br>No se puede tomar represalias contra los empleados por participar en cualquier investigaci\u00f3n o demanda relacionada con violaciones de la ley laboral o discriminaci\u00f3n en el lugar de trabajo.<\/li><li><strong>Ejercicio de los derechos en virtud de las leyes de seguridad en el lugar de trabajo<\/strong>:<br>Si un empleado denuncia condiciones de trabajo inseguras o rechaza un trabajo inseguro en virtud de la Ley de Seguridad y Salud Ocupacional de California (Cal\/OSHA), est\u00e1 protegido contra las represalias.<\/li><li><strong>Quejas por discriminaci\u00f3n y acoso<\/strong>:<br>Las protecciones se extienden a los empleados que presentan quejas por discriminaci\u00f3n (por motivos de raza, g\u00e9nero, edad, discapacidad, etc.) o acoso sexual en virtud de la Ley de Empleo y Vivienda Justos (FEHA).<\/li><li><strong>Permiso m\u00e9dico y por discapacidad<\/strong>:<br>Los empleados que solicitan o toman una licencia en virtud de la Ley de Derechos Familiares (CFRA), la Licencia por Discapacidad por Embarazo u otras licencias m\u00e9dicas est\u00e1n protegidos contra las represalias por ejercer estos derechos.<\/li><li><strong>Actividades o afiliaciones pol\u00edticas<\/strong>:<br>La ley de California tambi\u00e9n protege a los empleados contra las represalias por sus actividades o afiliaciones pol\u00edticas fuera del trabajo, siempre y cuando estas no interfieran con el desempe\u00f1o laboral.<\/li><li><strong>Servicio de jurado o comparecencias ante el tribunal<\/strong>:<br>Los empleados est\u00e1n protegidos cuando se toman un tiempo libre para el servicio de jurado o para comparecer ante el tribunal como testigo o litigante.<\/li><\/ol><h3><strong><br>Tipos de represalias<\/strong><\/h3><p>Las represalias pueden incluir:<\/p><ul><li>Degradaci\u00f3n<\/li><li>Denegaci\u00f3n de ascenso<\/li><li>Acoso<\/li><li>Reducci\u00f3n de salario u horas<\/li><li>Rescisi\u00f3n del contrato<\/li><li>Evaluaciones de desempe\u00f1o negativas<\/li><li>Inclusi\u00f3n en listas negras<\/li><\/ul><p><strong><br>Recursos legales<\/strong>: Si se producen represalias, los empleados pueden presentar una queja ante el Departamento de Cumplimiento de Normas Laborales de California o el Departamento de Vivienda y Empleo Justo de California, o pueden emprender acciones legales privadas. Los recursos podr\u00edan incluir la readmisi\u00f3n, el pago de salarios atrasados, los da\u00f1os punitivos y los honorarios de los abogados. <\/p><p>Estas leyes est\u00e1n destinadas a garantizar que los empleados puedan trabajar en un entorno en el que se sientan seguros para expresar sus preocupaciones o hacer valer sus derechos sin temor a represalias.<\/p><p>Sin embargo, <strong>demostrar las represalias<\/strong> puede ser <em>complejo<\/em>, ya que los empleadores podr\u00edan tomar represalias de forma sutil o alegar otras razones para sus acciones.<\/p><p>Es aconsejable documentar los incidentes y buscar una <strong>consulta con un abogado laboralista<\/strong> para las v\u00edctimas de represalias.<\/p><p>Podemos ayudarle.
