California Labor Code 1182.12

California Labor Code 510

California’s overtime regulations are governed by California Labor Code 510. The statute stipulates that employees are entitled to receive overtime pay, calculated at 1.5 times their regular hourly rate, for any hours worked over 8 in a single day. Furthermore, any hours exceeding 12 in a single day are compensated at double (2x) the regular hourly wage.

California Labor Code Section 512

In California, most workers are entitled to specific break periods. An uninterrupted 30-minute unpaid meal break is required when employees work over five hours in a day. Those who work in excess of 12 hours are entitled to an additional 30-minute unpaid meal break. Furthermore, employees receive a paid 10-minute rest break for every four hours of work completed.

California Labor Code 203

California Labor Code § 203 mandates a waiting time penalty for employers who intentionally delay the final paychecks of employees who are terminated or resign. This penalty amounts to the employee’s daily wage for each day the final paycheck remains unpaid, capped at 30 days.
